Welcome to Wellows (“Service”), a proprietary platform owned and operated by WEBAFFINITI-FZCO a legal entity organized and existing under the laws of United Arab Emirates, with its principal office located at Silicon Oasis, Dubai (“Company,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and the Company governing your access to and use of the Service. By accessing, registering for, or using the Service, including clicking any acceptance button or checkbox, you affirm that you have read, understood, and agree to be bound by these Terms.

We reserve the right to modify or update these Terms at our sole discretion. It enables you to streamline, automate, and optimize SEO-driven inbound marketing through AI-powered tools. With Wellows, you can effectively manage your organic search strategies, keyword research, content optimization, and performance tracking to enhance search engine visibility and drive sustainable growth.

The Wellows Web App allows you to:

• Conduct in-depth keyword research to identify high-ranking opportunities.
• Optimize on-page SEO elements like meta tags, headings, and structured data.
• Analyze search intent and competition to refine content strategies.
• Generate AI-powered content recommendations tailored for organic ranking.
• Track keyword rankings and SEO performance metrics over time.
• Automate content audits and technical SEO insights for better indexing and crawlability.
• Monitor backlinks, domain authority, and search engine visibility to strengthen organic reach.

By using the Service, you represent and warrant that:

• You are at least eighteen (18) years of age;
• You have the legal capacity to enter into this agreement;
• Your use of the Service complies with all applicable laws, rules, and regulations;
• If acting on behalf of a legal entity, you have the authority to bind that entity to these Terms.

To access the full features of the Service, you must register and create a user account. You agree to:

• Provide accurate, current, and complete information during registration;
• Maintain and promptly update your account information;
• Keep your login credentials secure and confidential;
• Notify us immediately of any unauthorized use of your account or other security breaches.

You are solely responsible for all activity conducted under your account. Account sharing, sub-licensing, or transfer without prior written consent is strictly prohibited.

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purposes;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any component of the Service;
• Interfere with, disrupt, or compromise the security or integrity of the Service;
• Upload or transmit content that is deceptive, infringing, libelous, or otherwise unlawful;
• Misuse AI-generated content for unethical or deceptive purposes;
• Reproduce, distribute, or resell the Service without prior authorization.

Violation of this section may result in immediate suspension or termination of your account, without prejudice to any other legal remedies available to the Company.

We reserve the right to suspend or terminate your account or access to the Service at any time, with or without notice, if:

• You breach any provision of these Terms;
• We suspect fraudulent, illegal, or abusive activity;
• We discontinue the Service in whole or in part.

You may cancel your account at any time through the dashboard. Prepaid subscription amounts may be refunded on a pro-rata basis at our sole discretion or where required by law.

The Service is provided "as is" and "as available" without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability.

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free;
• The AI-generated content will be accurate or suitable for any specific purpose;
• Results derived from using the Service will meet your expectations.

Each party ("Indemnifying Party") agrees to indemnify, defend, and hold harmless the other party ("Indemnified Party"), its affiliates, and their respective officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• For the User: any content submitted through the platform, use of the services in violation of these Terms, or infringement of third-party rights;
• For Wellows: any breach of its obligations under these Terms or infringement of third-party rights by the platform or underlying technologies.

This obligation is contingent upon the Indemnified Party providing prompt written notice of the claim to the Indemnifying Party, granting control of the defense and settlement to the Indemnifying Party (provided the settlement does not impose obligations or admissions on the Indemnified Party without its prior written consent), and cooperating fully in the defense.

To the fullest extent permitted by law, in no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or use, arising out of or relating to your use of the Service.

The Company’s total liability for any claims arising under these Terms shall not exceed the amount paid by you to the Company for use of the Service in the three (3) months preceding the event giving rise to the claim.

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates without regard to conflict-of-law principles.

Any disputes arising out of or in connection with these Terms shall be submitted to binding arbitration in Dubai, under the rules of Dubai International Arbitration Center, except where injunctive or equitable relief is sought for violations of intellectual property rights.

We reserve the right to modify or amend these Terms at any time. All modifications shall be effective upon posting on this page or notifying users through appropriate means. Your continued use of the Service constitutes acceptance of such changes.
